TERMS AND CONDITIONS

This promotion -- ASUS ProArtist Awards (“Promotion”) is hosted by ASUSTeK Computer Inc. (“ASUS”).

• Detailed information with respect to how to enter and win prizes in connection with this specific Promotion, ASUS Terms of Use Notice, and ASUS Privacy Policy, constitutes part of this Promotion Event Terms and Conditions (“Terms and Conditions”). Participation in this Promotion is deemed acceptance of these Terms and Conditions. ASUS may at any time revise the Terms and Conditions and other rules set forth by ASUS. “Eligible Entrants” (as defined below) and “Entries” (as defined below) shall be bound by any such revisions.

• The Promotion commences on April 15th, 2023 00:00 GMT and terminates on July 24th, 2023 10:00 GMT (“Promotion Period”) and hosts globally (“Promotion Territory”).

• Employees of ASUS and its parent companies, affiliates, subsidiaries, advertising representatives and agencies, who are involved in the Promotion, and the immediate families of any of the foregoing persons, are NOT ELIGIBLE for this Promotion.

• People who live in the Promotion Territory and would like to participate in this Promotion during the Promotion Period acknowledge as follows:
  
  A. An Eligible Entrant (as defined below) under the legal age shall provide proof materials about their legal guardians and such legal guardians' consent to their participation in the Awards as well as other necessary materials that are deemed necessary by ASUS if a prize is won.
  
  B. Provided you registered for ASUS membership with your personal information, i.e. name, email address, and date of birth (“Personal Information”), you will be eligible (“Eligible Entrants” or “Entrant”) for this Promotion.
  
  C. An Entrant will submit no more than one (1) Entry per category during the promotion period. If it is discovered or suspected, in ASUS’s sole discretion, that an Entrant plays or attempts to submit more than the stated number of Entries, all of that Entrant’s Entries, in ASUS’s sole discretion, may be declared null and void and any prize(s) they might have been entitled to will not be awarded to them.
  
  D. All Entries must be submitted via the ASUS ProArtist Awards official website, and the format, content of the Entry must follow the submitted category guideline to be eligible for this Promotion. For each category’s specific guideline, please refer to the Rules tab.
  
  E. For the First place and Second place (collectively, “Winner”) in four categories, entries will be judged by our professional jury panel on Creativity and uniqueness, Wow factor and eye-catching appeal, Relevance to the competition theme, Aesthetics and Skill and technical execution. Please refer to Rules tab for more information. The decision of the ASUS ProArtist Awards organizers is final.
  
  F. Any kind of AI Generated art is not allowed of this Promotion. If it is discovered or suspected, in ASUS’s sole discretion, that an Entrant plays or attempts to submit any AI Generated Entry, all of that Entrant’s Entries, in ASUS’s sole discretion, may be declared null and void and any prize(s) they might have been entitled to will not be awarded to them.
  
  G. Winners must be able to provide a high resolution original file of the Entry decided by ASUS, as original copies are required to receive an award. This file will be used only to prove the ownership of the image. Winning Entrants who do not fulfill these eligibility criteria will be deemed ineligible and disqualified without the right to appeal.
  
  H. All Entries must be the original work of the Entrant and must not infringe the rights of any other party. The entrant must be the sole copyright owner, or be able to provide a proof of acquiring all necessary and sufficient rights for this Promotion from third party, of all works entered, including but not limited to music, sound, photographs, graphics, video, messages and any other third party materials in the work. And must have obtained permission of any people featured in the entries (or their parents/guardians if children under 16 are featured). Further, the entrant must not have breached any laws when creating their Entry.
  
  I. Entries must not be published works, including but not limited to commercial works, works with logos or any other works opened to the public. Works that have been submitted to other competitions are not allowed to enter. Entrants must be able to prove that this is the first time entries have been published and have not entered previous competitions.
  
  J. You agree to participate in related publicity and to the use of your name and images for the purposes of advertising, promotion and publicity in connection with the ASUS ProArtist Awards without additional compensation.
  
  K. For all Entries, copyright holders grant ASUS to perpetually use such Entries in themes-related activities for publicity purposes worldwide including social media, online and print, in relation to the contest and all promotional activities without any remuneration being due. Entries will be used strictly in connection to this Promotion and will not be used for any other marketing purposes other than to promote the ASUS ProArtist Awards. Entries will not be resold or used by any other third party. If there is a request for such, we will forward that request to copyright owner of the work via email.
  
  L. ASUS ProArtist Awards and ASUS assume no responsibility and are not liable for any Entry misuse by external third parties.
  
  M. Winners will be published on the official website on August 15th, 2023. We will get in touch with the Winner via the email provided by Entries to confirm the eligibility of the art work and information to send corresponding prizes. If the Winner does not response within 1 week, it will be deemed that the Winner has voluntarily renounced the right to the award and prize, and ASUS will have the right to choose another new Winner.
  
  N. Prize will be cash or hardware as listed in ASUS ProArtist Awards official website at https://www.asus.com/campaign/ASUS-ProArtist-Awards-2023/global/prizes) For prize value and detailed information, please also refer to ASUS ProArtist Awards official website. Cash prizes will be paid in US$ by wire transfer so a bank account that is able to accept US$ will be required. Any fees incurred for wire transfer will be deducted from the prize amount. Winner shall provide their full name, physical address, phone number, passport image and all necessary information for delivering the prize to verify identity and deliver the prize.
  
  O. Winners will need to fill in necessary documents provided by ASUS in order to complete for sending prize. Paperwork and transaction process might take more than 3 months to complete.
  
  P. The hardware prizes listed on ASUS ProArtist Awards official website are subject to region and storage availability; ASUS reserves the rights to offer an alternative of equal value.
  
  Q. Eligible Entrant will need to complete the below actions to be eligible to join the Giveaway Lucky Draw:
  
  (1) Entrant submit Entry through ASUS ProAritst Awards website and within Promotion Period
  (2) Follow ProArt Instagram Channel (https://www.instagram.com/proart/) and join ProArt Discord Server (https://discord.gg/zvsdMkpuhb)
  (3) Share Entry on Entrant’s own public Instagram and use hashtags #ASUS #ProArt #ProArtistAwards2023 and tag @ASUS @ProArt (“Artwork with Instagram”)
  
  R. The Lucky Draw winners will be randomly selected from all Artwork with Instagram. Every Entry is only allowed to win the Giveaway Lucky Draw once during the Promotional Period. After selecting the Lucky Draw winners, ASUS will announce their information with partial personal information masked on social media platform page managed by ASUS, and contact them to verify their identity and request their full name, physical address and phone number and all necessary information for delivering prize.
  
  S. If the Lucky Draw winner does not response within 1 week or the prize cannot be delivered due to incomplete personal information, it will be deemed that the Lucky Draw winner has voluntarily renounced the right to the a prize, and ASUS will have the right to select another new Lucky Draw winner.
  
  

• Entrants acknowledge and agree that the personal information provided is true and valid. ASUS will only collect and process your personal information within the scope of the above-stated purposes. Please ensure that your personal information is complete and accurate.

• NO PURCHASE NECESSARY. No purchase is necessary to participate in the Promotion. A purchase will not improve Entrant’s chances of winning.

• Survival
  If any clause of these Terms should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted and the remaining clauses shall survive and remain in full force and effect.

• Limitation of Liability
  ASUS MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY OFFER OR THE PARTICIPATION OF THE USER IN THE OFFER. BY PARTICIPATING IN THE OFFER, USER AGREES TO RELEASE AND HOLD ASUS AND ITS EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, REPRESENTATIVES, AND THEIR AFFILIATES, SUBSIDIARIES, PARENTS, ADVERTISING, PROMOTION AND FULFILLMENT AGENCIES, AND LEGAL ADVISORS HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND IN CONNECTION WITH THE OFFER OR RESULTING FROM ACCEPTANCE, POSSESSION, OR USE OF ANY OFFER, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY, DEATH, AND PROPERTY DAMAGE, AND CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION, OR INVASION OF PRIVACY.
